My client applied for Social Security Disability benefits with more than enough work credits, and conditions that qualified her to receive benefits according to Social Security’s rules.
Unfortunately, her claim was denied. We appealed and went to a hearing with an Administrative Law Judge, and her claim was again denied. That judge decided that her conditions weren’t bad enough to keep her from work.
Since we believed she definitely qualified for disability benefits we helped her submit another application, which was denied (as we expected it would be) at the initial level.
We requested another hearing with an Administrative Law Judge who finally approved her to receive benefits! The judge determined that the people who had denied her benefits before hadn’t fully considered how severe they are and how they keep her from work.
She was awarded $39,000 in back pay.
